This Acceptable Use Policy ("AUP") applies to all persons and entities using products, networks, systems, IP addresses, infrastructure, or services provided by Solid Systems, LLC ("SolidVPS"). This AUP forms part of the SolidVPS Terms of Service. Use of the Services constitutes acceptance of the AUP then in effect.
Customers are responsible for all activity originating from, occurring through, or associated with their Services, accounts, users, credentials, applications, content, IP addresses, and systems, whether the activity is performed by the Customer, an authorized user, a downstream user, or a third party who gains access to the Customer's environment. Customers must maintain appropriate security and promptly investigate and remediate suspected compromise or abuse.
SolidVPS may modify this AUP by posting an updated version. No failure or delay by SolidVPS in enforcing any provision constitutes a waiver of that provision or any other right.
SolidVPS is an infrastructure and hosting provider and does not undertake to determine the ultimate merits of private disputes between a Customer and a complainant. Non-DMCA abuse, trademark, patent, trade dress, impersonation, unfair-competition, publicity-right, privacy, and similar complaints may be forwarded to the Customer for review and response. SolidVPS may request additional evidence from either side and may direct a complainant to appropriate legal process when the dispute cannot reasonably be determined by SolidVPS.
Copyright and DMCA notices are different. Where the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512, applies, SolidVPS may process notices and counter-notifications in accordance with the statutory notice-and-takedown framework and the SolidVPS Terms of Service. Forwarding a DMCA notice to a Customer does not replace any action SolidVPS determines is required to preserve applicable legal protections or comply with law.
Customers must cooperate with legitimate abuse and legal-compliance investigations and are responsible for promptly securing compromised systems. A Customer's assertion that activity was unauthorized, caused by malware, or caused by a third party does not prevent SolidVPS from taking temporary or permanent protective action while the matter is investigated.
SolidVPS's receipt, forwarding, investigation, escalation, restriction, suspension, restoration, or other handling of a complaint does not constitute an admission of liability, a representation that the complaint is valid or invalid, or an assumption of the Customer's legal obligations. Customers remain responsible for their content, systems, users, licensing, and legal compliance and must indemnify SolidVPS as provided in the Terms of Service.
Unacceptable use includes, but is not limited to, any of the following: posting, transmitting, re-transmitting, or storing material on or through any Solid Systems, LLC product or service, if in the sole judgment of Solid Systems, LLC such posting, transmission, re-transmission, or storage is: (a) threatening or abusive; (b) obscene; (c) indecent; (d) defamatory; or (e) in violation of local law or regulation (including rights protected by copyright, trade secret, patent, or other intellectual property or similar laws or regulations). Each customer is responsible for determining which laws or regulations apply to their use of the products and services.
The list of prohibited content below includes, but is not limited to, the following:
If prohibited or high-risk activity is detected or reasonably suspected, SolidVPS may suspend, restrict, null-route, isolate, or terminate affected Services, with or without prior notice as circumstances reasonably require. Services suspended or terminated for an AUP or Terms of Service violation are non-refundable to the fullest extent permitted by applicable law. Protective action may be based on technical evidence, third-party or upstream reports, legal process, security indicators, or other information SolidVPS reasonably considers reliable.
Actions that restrict or inhibit anyone — whether a customer of Solid Systems or otherwise — in their use or enjoyment of Solid Systems products and services, or that generate excessive network traffic through the use of automated or manual routines unrelated to ordinary personal or business use of Internet services, are prohibited.
Introduction of malicious programs into the Solid Systems network, servers, or other products and services of Solid Systems (e.g., viruses, trojan horses, and worms) is strictly prohibited.
Causing or attempting to cause security breaches or disruptions of Internet communications is prohibited. Examples of security breaches include, but are not limited to, accessing data for which the customer is not an intended recipient, or logging into a server or account that the customer is not expressly authorized to access. Examples of disruptions include, but are not limited to, port scans, flood pings, packet spoofing, and forged routing information.
Executing any form of network monitoring that intercepts data not intended for the customer is prohibited.
Circumventing user authentication or security of any host, network, or account is prohibited.
Installation or distribution of "pirated" or other software products that are not appropriately licensed for use by the customer is prohibited.
Interfering with or denying service to any user other than the customer's own host (e.g., denial-of-service attacks, NTP attacks, injections, etc.) is prohibited.
Using any program, script, or command — or sending messages of any kind — designed to interfere with or disable a user's terminal session is prohibited.
Furnishing false or incorrect data on the order form or contract (electronic or paper), including fraudulent use of credit card numbers or attempting to circumvent or alter the processes or procedures used to measure time, bandwidth utilization, or other methods used to document the use of Solid Systems products or services, is prohibited.
Sending unsolicited mail messages — including "junk mail" or other advertising material — to individuals who did not specifically request such material, who are not previous customers of the customer, or with whom the customer does not have an existing business relationship (e.g., email spam) is prohibited.
Harassment, whether through language, frequency, or size of messages, is prohibited.
Unauthorized use or forging of mail header information is prohibited.
Solicitation of mail or any other email address other than the poster's own account or service, with the intent to harass or collect replies, is prohibited.
Creating or forwarding "chain letters" or other "pyramid schemes" of any type is prohibited.
Use of unsolicited email originating from within the Solid Systems, LLC network or from networks of other Internet service providers to advertise any service hosted by Solid Systems or connected via the Solid Systems, LLC network is prohibited.
Exporting, re-exporting, or permitting downloads of any content in violation of export or import laws without all required approvals, licenses, and exemptions is prohibited.
HYIP (High Yield Investment Program) sites are not allowed.
No failure or delay in exercising or enforcing this policy shall constitute a waiver of the policy or of any other right or remedy. If any provision of this policy is deemed unenforceable due to law or a change in law, that provision shall be disregarded and the remainder of the policy shall remain in effect.
Customers are solely responsible for identifying and complying with every law, regulation, permit, license, registration, authorization, industry rule, contractual obligation, and third-party requirement applicable to their business, content, data, users, transactions, products, software, and use of the Services. The availability of a Service, operating system, software image, IP address, datacenter location, network feature, payment method, or other capability does not constitute approval, certification, authorization, legal advice, licensing advice, or a representation by SolidVPS that the Customer's intended use is lawful or compliant.
Customers may not use the Services in violation of applicable U.S. sanctions, export controls, embargoes, blocked-person restrictions, anti-money-laundering laws, or other trade restrictions, or to evade or circumvent them. SolidVPS may reject, block, suspend, restrict, preserve, or terminate Services or transactions when reasonably necessary for sanctions, export-control, legal, contractual, fraud, security, or regulatory compliance, and may require identity, ownership, source-of-funds, business-purpose, or other verification where lawful.
SolidVPS does not undertake a general duty to monitor Customer content, traffic, licensing, or activity for violations. The ability to investigate or take action in one matter does not create a duty to do so in another. SolidVPS may use automated or manual measures to protect its systems, customers, upstream providers, and third parties, and may preserve relevant records where reasonably necessary for security, abuse handling, dispute defense, legal compliance, or enforcement of its agreements.
Customers are solely responsible for ensuring that their use of the Services, including use by their users and downstream customers, complies with applicable law, third-party rights, licenses, and this AUP. The defense and indemnification provisions of the SolidVPS Terms of Service apply to claims, demands, investigations, subpoenas, regulatory inquiries, notices, proceedings, judgments, settlements, liabilities, losses, penalties or assessments to the extent lawfully indemnifiable, costs, and reasonable attorneys’ fees arising from Customer content, activity, users, abuse, infringement, licensing, security incidents, regulated activity, or violation of this AUP.
Upon notification of the existence of an abusable resource (e.g., an open news server, unsecured mail relay, or smurf amplifier), the customer shall immediately take all necessary steps to prevent any further abuse of such resource. Any abuse of an open resource that occurs after the customer has received such notification shall be considered a violation of this policy and enforced accordingly.
You are allocated a monthly bandwidth allowance, which varies depending on the hosting package you purchase. Should your account exceed the allocated amount, we reserve the right to suspend the account until the start of the next billing cycle, suspend the account until additional bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher package, terminate the account, and/or charge you an additional fee for overages. Unused transfer in one month cannot be carried over to the next month.
